"You", and Jonathan Washtell, trading as Private Holidays on Menorca with offices at 8 New Copper Moss, Altrincham, Cheshire, WA15 8EG hereby known as "Us","Our" or "We".
"Booking Form" the Internet based booking facility provided at www.holidayhomerentalsonline.com or any such form provided by Us to You.
"The Property" is the accomodation identified in SECTION E and includes all fixtures and fittings internally and externally.
"You","Your" the party leader as identified on Our booking form.
"Your Party" all those persons occupying The Property during the rental period.
"Property Owner" the owner of the The Property who is named in Section E.
A. Our Agreement with You
1. The Contract and Confirmation
i. The terms and conditions set out in this general section together with those in Section E and Your confirmation invoice comprise the agreement between Us and You and Your Party on whose behalf you are making this booking.
ii. The contract is not made until We have confirmed the booking and issued a written confirmation to You and issued to You with a confirmation invoice (subject to iii). It is only then that a contract exists.
iii. It is important that You check all the details shown on the confirmation invoice carefully to ensure they are correct as this forms the basis of the contract. Any discrepancies should be brought to Our attention within seven days of issue otherwise the details shown on the confirmation invoice will be presumed to be correct.
iv. Please note that checking availability via the website, e-mail or over the telephone does not constitute confirmation of the booking. Assuming that We are able to confirm your booking, We will send Your confirmation invoice within 10 working days of receipt of the deposit or full payment at Our bank.
v. We always do our best to ensure that our web-site and other materials are accurate and up-to-date. Photographs are intended to give an overall impression rather than factual details. Items that appear in the accommodation photographs may not be the same as those when you arrive as there may have been changes or items removed before your arrival.
2. Price
i. We reserve the right to increase or decrease Our prices at any time, though the price shown on your confirmation invoice will not be increased unless You amend the booking in any way after it is made. However, We guarantee that no surcharges will apply once you have made Your booking.
3. Cancellations and Alterations by Us
i. We reserve the right to cancel a booking at any time if by reason of war, political unrest, strikes, interruption of communications, exchange control, unavailability of accommodation or otherwise, We regard it as essential to do so.
ii. If We make such a cancellation, We will offer You comparable alternative arrangements, if available, or a full refund of all sums paid to Us in respect of Your booking less (where cancellation is by reason of factors outside Our control, such as those circumstances mentioned above) all losses and expense sustained by Us in respect of the booking.
4. Our Liability to You
i. We shall not be under any liability for any injury, death, inconvenience, damage, loss, accident, delay or additional expense howsoever caused, occasioned to or incurred by You , Your Party or any other person due to circumstances beyond Our control and in absence of negligence by Us or our servants. In terms of transport it is Your responsibility to check with the chosen carrier as to liability.
ii. We cannot accept responsibility if You or any member of Your Party should miss the outbound or homebound flights due to late check-in at the airport.
iii. No responsibility can be accepted for the breakdown of public supplies including water and electricity.
B. Your Agreement with Us
1. Booking Your Accomodation and Understanding the Contract
i. When You wish to confirm a booking You must pay a deposit of 20% of the rental price. Once Your booking has been confirmed by Us, the deposit will not normally be refunded except in circumstances set out in clause A 3. above or We choose to return the deposit as We have been able to find other guests to occupy the property. It is Our aim to be fair and just.
ii. You are responsible for organising Your own holiday insurance and must take adequate care that You and Your Party are properly covered.
iii. If the booking takes place within ten weeks of departure then full payment is required for confirmation of the booking. Once this order and payment have taken place any monies are not refundable except in section A 3. above.
vii. Upon receipt of Our confirmation invoice, unless any discrepancies are brought to Our attention (see section A 1.iii - Our Agreement With You), it will be deemed You are confirming your acceptance of these Booking Conditions and the IMPORTANT INFORMATION (SECTION D) on behalf of Your Party and any other persons who will be occupying the property which forms the basis of the contract between us.
viii. Telephone quotes and web-site prices are all provided subject to confirmation.
2. Payments
i. You must make payment to Us of the balance shown on the confirmation invoice sent to You at least ten weeks before departure, or if Your booking is made within this period, You will have to pay the full amount immediately.
ii. If You do not pay in full by the date shown on the final invoice We reserve the right to cancel Your booking if we so wish which will make You liable for cancellation charges as set out in the table shown in paragraph 4. (Cancelling Your Booking) of this section.
3. Transferring Your Booking
i. If You are prevented from travelling you may transfer Your booking to another person or group, as long as You give Us at least 21 days notice and the arrangements remain exactly the same as the original booking. You must also agree to pay any charges, or levy, We may incur to make this change. For the purpose of this contract We define "prevented" to be death, accident, illness, jury service or witness summons, or redundancy of yourself, travelling companion or close relative, etc.
4. Cancelling Your Booking
i. If You cancel Your booking You must advise us in writing, by email, or post immediately. If You cancel you will be liable to pay cancellation charges but which, at Our own discretion, We may choose to reduce or waive. Cancellation periods are calculated on the date of your cancellation being received by us at our offices and email cancellations@holidayhomerentalsonline.com
ii. Cancellation Charges. The cancellation charges are set out in the table under section E. The Property - additional Terms and Conditions ( 7. Cancelling Your Booking ii ) if present, otherwise in the table below. The term "Total Accomodation Cost" in the table means the total cost for all persons included on the booking and for all accommodation listed in the booking and shown on Our confirmation invoice, if cancellation occurs prior to the stated rental start date.
Period before rental start date when your cancellation notification is received. Cancellation charge expressed as % of Total Accomodation Cost.
70 days (10 weeks) or more - Deposit
between 45 and 69 days - 25%
between 44 and 35 days - 50%
between 34 or fewer days - 80%
day of departure - 100%
To cover the cost of any cancellation charges You are strongly advised to take out adequate and appropriate insurance for cancellations.
C. Your Agreement with the Property Owner
1. Terms and Conditions
i. We act as an authorised booking agent for the individual Property Owners. Each Property has individual Terms and Conditions (Section E) that forms part of these Terms & Conditions. In accepting these Terms & Conditions you also accept those conditions listed in Section E.
D. IMPORTANT INFORMATION
1. Your Holiday Home Price Includes
i. Those items list in the specific property rental agreement Section E which forms part of these Terms & Conditions
2. Swimming Pools
Where The Propery has a swimming pool ( private or shared facility), the period when the pool is available is at the Property Owner's discretion, and may also be affected by local weather conditions. As they operate outside Our control, We cannot guarantee their availability.
3. The Property - Damages and Security Deposits
You and Your Party are obliged to treat the property, it's contents, and all items belonging to the property with care and respect. If You , Your Party or any invited persons accidently break or damage something please replace with like and inform the Property Owners' local representative ( housekeeper/property manager). So that it can be put right for the next guests if You were not able to replace it. After confirmation of your booking You will receive an information pack containing contact details of the Property Owners' local representive.
You are liable for all damages You or Your Party, invited guests or accompanying animals cause. To cover the cost of any damage claims by the Propery Owner You MUST have adequate travel insurance.
Where stated for The Property, a security deposit is usually payable locally to the Property Owner or their local agent to protect against possible damage and any relevant phone charges where The Property has a telephone for guests' usage. Where applicable this is detailed in Section E. Security deposits are payable by cash in local currency or negotiable in Pounds or travellers cheques subject to the Property Owner or local agent. Property Owners or their housekeeper/property managers will check for damages after Your departure-Please inform rather than let people discover the damage so that following guests will not be dissapointed.
4. The Property - Arrival / Departure
The Property is cleaned before Your arrival but not during your stay (unless otherwise stated in Section E). The Property is normally available to occupy on the day of Your arrival at 12 noon or as specifically defined in Section E. On the day of departure You and Your Party should vacate the Property by 10 am or as stated in Section E. Before departure You are requested to clean the following items if present - ovens, cooking hobs, microwave oven, fridges/freezers, cooking utensils, pans, glasses and dishes.
5. The Property - Other Information
You and Your Party must not use the provided bath/handtowels outside of The Property. You and Your Party are NOT allowed to smoke anywhere inside the Property unless otherwise stated in Section E.
In the case of a fault which may cause a disruption to the use of or damage to The Property or any surrounding properties e.g. a burst water pipe, You and Your Party are obliged to make all reasonable efforts to:-
a) help with and try to resolve the problem and,
b) to keep any possible resulting damage or disruption to a minimum.
The Property may only be occupied by the number of persons stated in the confirmation invoice. In the case of more people occupying the property then the Property Owner or it's named agent is authorised to demand an appropriate remuneration for the period of the over occupation, and to request the additional persons to immediately leave the property.
Due to wetness ( rain, splashed water ) tiled or paved areas of the property, balcony and swimming pool may become slippery. You are obliged to point this out to Your Party and any invited guests to The Property to prevent accidents.
The Owner will try to ensure that Yhe Property and it's contents are in good order. However, it is possible that previous guests have broken, damaged or accidently removed an item and the Property Owner has not been able to correct this. Please inform the Property Owner of their local representative ( housekeeper/property manager)
In the case of breakdowns in The Property the Property Owner, local housekeeper/property manager MUST be advised immediately. They will use their best endeavours to repair the fault as quickly as possible. Failure to do so may adversely affect any disputes on Your return.
You and Your Party must observe the rules of the community (if any) relating to any accommodation provided. For example, realating to noise levels between certain hours.
6. Passport and Visas
It is Your and Your Party's responsibility to be in possession of a full ten year passport and any necessary visas. Under 16's who are not already included on their parents' passport are required to have their own passport. A visa is not necessary for British passport holders. Holders of non-EU and EEA passports and non-British citizens are strongly advised to check with the relevant consulate whether a visa is required, and with British Immigration for re-entry into the UK.
